Welcome to Tulayraa. These Terms of Service ("Terms") govern your use of our website, mobile application, and at-home beauty services (collectively, the "Services") operated by ETHELUXE SERVICES PRIVATE LIMITED ("we," "us," or "our").

By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Services. Please read these Terms carefully before using our Services.

1. Acceptance of Terms

By accessing or using our Services, you confirm that you accept these Terms and agree to comply with them. If you are using our Services on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms.

2. Service Description

Tulayraa provides at-home beauty services in Kolkata, including but not limited to:

• Nail extensions and nail art
• Skin services and facials
• Mehndi application
• Hair treatments and styling
• Makeup services
• Male grooming services

Our Services are provided by trained beauty professionals who travel to your location to perform the requested services. The availability of specific services may vary based on location, beautician availability, and other factors.

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. You are responsible for safeguarding the password that you use to access our Services and for any activities or actions under your password.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Booking and Appointments

4.1 Booking Process

You may book our Services through our website, mobile application, or by contacting our customer service. By booking a service, you agree to provide accurate and complete information, including your name, contact details, address, and service preferences.

4.2 Confirmation and Scheduling

After you submit a booking request, we will confirm the availability of the requested service and beautician. Once confirmed, you will receive a booking confirmation with the date, time, and details of your appointment.

4.3 Cancellation Policy

You may cancel or reschedule your appointment at least 24 hours before the scheduled time without any penalty. Cancellations made less than 24 hours before the scheduled appointment may incur a cancellation fee of 25% of the service cost. No-shows may be charged 50% of the service cost.

5. Service Delivery

5.1 Service Location

You agree to provide a clean, safe, and suitable space for our beauticians to perform the requested services. You must ensure access to necessary utilities such as water, electricity, and adequate lighting.

5.2 Service Timing

Our beauticians will arrive at the scheduled time. If you are not available or the service location is not accessible at the scheduled time, the beautician may wait for up to 15 minutes. After this waiting period, the appointment may be considered a no-show.

5.3 Service Modifications

If you wish to modify the service during the appointment, the beautician will accommodate reasonable requests if time and resources permit. Additional services may incur extra charges, which will be communicated to you before proceeding.

6. Payment Terms

6.1 Pricing

The prices for our Services are listed on our website and mobile application. Prices may vary based on the type of service, duration, complexity, and location. We reserve the right to modify our prices at any time without prior notice.

6.2 Payment Methods

We accept various payment methods, including cash, credit/debit cards, and digital payment platforms (UPI, Google Pay, PhonePe, Paytm). Payment is typically collected after the service is completed, but we may require advance payment for certain services or during peak seasons.

6.3 Taxes

All prices are inclusive of applicable taxes unless otherwise stated. You agree to pay all taxes, duties, and other governmental charges applicable to your use of our Services.

7. Health and Safety

7.1 Allergies and Sensitivities

You are responsible for informing us about any allergies, sensitivities, or medical conditions that may affect the delivery of our Services. We reserve the right to refuse service if we believe it may pose a health risk to you.

7.2 Hygiene Standards

Our beauticians follow strict hygiene protocols and use sterilized equipment. You agree to maintain a clean environment for the service delivery and to follow any hygiene instructions provided by our beauticians.

8. Intellectual Property

The content on our website and mobile application, including text, graphics, logos, images, and software, is the property of Tulayraa and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our express written permission.

9. User Content

If you submit reviews, comments, or other content to our platforms, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.

You represent and warrant that your content does not violate any third-party rights and complies with all applicable laws and regulations.

10. Limitation of Liability

To the maximum extent permitted by law, Tulayraa and its affiliates, officers, employees, agents, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Services.

11. Indemnification

You agree to defend, indemnify, and hold harmless Tulayraa and its affiliates, officers, employees, agents, and partners from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.

12. Termination

We may terminate or suspend your account and access to our Services immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms.

14. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Kolkata, West Bengal, India.
